Post Conviction

Criminal Conviction Removal

Attorney, Kiran Nair has successfully vacated misdemeanor and felony criminal convictions such as possession of control substance, drug trafficking, domestic violence and theft offenses through post-conviction relief. Certain criminal convictions classified as crimes involving moral turpitude (CIMT), or aggravated felony under the U.S. Immigration Laws disqualify immigrants from becoming eligible for temporary and permanent resident status or green-card. In 2016 and 2017, the State of California enacted various laws which could help many immigrants vacate serious or damaging criminal convictions.  The conviction must be vacated on legal or Constitutional grounds rather than expungement or dismissal pursuant to Cal. Penal Code section 1203.4.  Successful post-conviction relief requires significant supportive documentary evidence including detailed statements under penalty of perjury from the immigrant, and case is litigated in the Criminal Court where immigrant was convicted.  If you or a loved one has a criminal conviction disqualifying from obtaining temporary or permanent resident status then contact our office for a consultation as soon as possible because vacating a conviction requires that the immigrant applied for post-conviction relief in a timely manner.

Represented My Son With Criminal and Immigration Issues

“Attorney did everything that was needed to help my son. She was very patient with him and kept on calling him when she needed items from him. My son was difficult to deal with but she still did everything she could to help him. We were very happy with her work and would confidently retain her services again if we were to need them. I would recommend her 100%.”
